The comittee has reviewed the current terms and conditions and have updated them as part of our 6 monthly processes

1. General.
Please read these Terms and Conditions (T&Cs) carefully. These T&Cs include our policy for acceptable use of Club VR-4, its content and content posted on the Forum, your rights, obligations and restrictions regarding your use of this Site.

By accessing Club VR-4, you accept, without limitation or qualification, these T&Cs. You are only authorised to use Club VR-4 and its services if you agree to abide by all of these Terms. If you do not accept these T&Cs, you must discontinue use of Club VR-4 .

We may modify these T&Cs from time to time, posting will not be possible until the new T&Cs have been accepted - There will be a count down before the accept button becoms available.

Please note that all Committee members have volunteered to assist in the running of the Club in their own free time and receive no reward. While being accepted onto the Committee involves a number of responsibilities regarding not only the general running of the Club, but also of the forums, e.g. moderating threads, issuing user infractions, dealing with spam and various other enquiries, being as the nature of the role is voluntary, there may well be occasions that Committee members are not available for one reason or another.2. Content
Club VR-4 provides you and other users with an opportunity to submit, post, display, transmit and/or exchange information, guides, articles, ideas, opinions, photographs, images, video, creative works or other information, messages, transmissions or material to us, the Forum or others ("Post(s)").

Posts do not reflect the Club VR-4 views; and we have no obligation to monitor, edit, or review any posts on the Forum. Club VR-4 assumes no responsibility or liability arising from the content of any such Postings (including the Resource Library and/or Articles Library), nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, completeness, accuracy, inaccuracy, completeness or validity contained in any information within such Post found on this Site or on our Forum.

The Club VR-4 Committee reserves the right to edit, lock or delete any message for any reason whatsoever, at our discretion. You agree that you are solely responsible for the content of your messages and that you will indemnify and hold harmless Club VR-4 with respect to any claim based upon the appearance and/or transmission of your message(s).

You are prohibited from posting or transmitting any unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic, invasive of a person's privacy, violate any law, advertisements, chain letters, pyramid schemes, solicitations or any profane material that could constitute or encourage conduct that would be considered a criminal offence.

You also agree that you will not post any copyrighted material without the express permission of the copyright holder, unless such copyright is owned by you, this forum or the Club VR-4 website.

Without limiting the foregoing, the following behaviours are strictly prohibited:



2.01. Strong, vulgar, obscene or otherwise harmful language regardless of the intent..
2.02. Alienate or antagonise other Club VR-4 Members.
2.03. Racially, ethnically or otherwise, objectionable language.
2.04. Harassing, intimidating, stalking or threatening other Club VR-4 Members.
2.05. Libellous, defamatory or otherwise tortuous language.
2.06. Impersonation of another person or persons.
2.07. Posting, distributing, transmitting or promoting illegal content.
2.08. Invasion of another’s privacy.
2.09. Abusing the Committee Feedback for ones own benefit and/or with malicious intent.
2.10. Actions that are hurtful or harmful to minors.
2.11. Posting, providing, transmitting or otherwise making available any materials or information infringing on the rights of a third party.
2.12. Trading without Trader Status, including links in signatures/profiles etc, or coercion of other members to act in the same way.

The Club VR-4 Committee have the ability to edit and/or remove messages which they believe to be unacceptable to either themselves or other users of this forum. However, it is impossible for The Club VR-4 Committee to monitor every message.



2.13. Any user who believes that a posted message violates any of the Terms & Conditions should contact us immediately by using the ‘Committee Feedback’ (Sometimes referred to as "Report" or "Report Post") button on the post in question, never contacting a Club VR-4 Committee directly. Upon receipt of such notification, we will make every effort to take whatever action is necessary as soon as is practically possible. However, as this is a manual process, you should be aware that we may not be able to remove or edit reported messages immediately, or at all. Note that the committee is a global unit, as such we stipulate at least a 24hr turnaround for dealing with such requests. Abuse of the Feedback button will not be tolerated and considered an attempt to antagonise other Club VR-4 Members.


2.14. If Club VR-4 believes that any of the T&Cs have been contravened we retain the right to inspect and/or monitor any electronic information stored on Club VR-4. This information may be used to determine the severity of the breach (of the T&Cs) and/or provided to any legal body making just requirements. 3. Forum Etiquette & Life Etiquette

You agree that you will follow the basic principles of forum and life etiquette as summarised below:



3.01. One should always be courteous, and treat others as you would wish to be treated.
3.02. Before creating a new topic thread, one is advised to search to see if a similar topic already exists.
3.03. Contributors should follow standard grammar, spelling rules and avoid slang or text speak.
3.04. One should strive to post in the correct forum/category.
3.05. When making a technical enquiry, one should include as much technical information as possible, especially in the subject line.
3.06. Contributors are asked to stay on-topic.
3.07. One should think twice before posting, consider the feeling of others and how they may or may not perceive your contribution.
3.08. To avoid appearing self-absorbed, one should respond to topics started by others more often than starting topics of their own.
3.09. Contributors should avoid the use of all CAPITAL LETTERS in posts. All CAPS is considered "shouting" and causes readability issues.
3.10. One is advised not to resurrect a very old topic if nothing significant will be added. This practice is known as revival or Necroing.
3.11. One should try to refrain from lashing back at a poorly behaving member or participating in a flame war; instead, notify a committee member of the event using the "Committee Feedback" Button.
3.12. When quoting a previous post, one should only include the relevant portion of that post.
4. Infractions.
The User Infraction system is designed to automate the management of Club VR-4 Members who are not conducting themselves within accordance of the Terms & Conditions of Club VR-4.

The infraction system is based on points. If you accumulate a specific number of points, various actions will be automatically dealt out, details of which can be found below.

If the Club VR-4 Committee believe you have violated one or more of our Terms & Conditions, they will issue you a warning or an infraction. If you receive an infraction, first you will get an automatic PM from the mod that issued you the infraction. This PM will have an explanation of what we believe you violated, which infraction you have received, and the point value (if applicable).

There are times we may feel that a warning is best suited for a certain situation. Warnings do not carry point values, if an Infraction is issued your point value will go up by a pre determinded set number of points, depending on the "something" of the violation. Each infraction you receive has a expiration time. Once an infraction expires, it is removed from your account.

An infraction can also be extend, in such cases the expiration time is extended based on the time limit original active infraction.

For example: You have received an infraction for a Personal Attack on another Club VR-4 member, this has an expiration time of 60 days. Then say two hours later you receive another Personal Attack infraction. The second infractions expiration time will be added to the first. So, instead of waiting 60 days, you now have to wait 120 days for the infraction to expire.

Each time you receive an infraction you are required to review and agree the T&Cs.

Details of Scoring and Consequences which may be received for going against the following.


Minor - 1 Point

Medium - 3 Points

2.07. Posting, distributing, transmitting or promoting illegal content.

6. Links - dubious links

Major - 7 Points
2.02. Alienate or antagonise other Club VR-4 Members.
2.03. Racially, ethnically or otherwise, objectionable language.
2.04. Harassing, intimidating, stalking or threatening other Club VR-4 Members.
2.08. Invasion of another’s privacy.
2.10. Actions that are hurtful or harmful to minors.
2.11. Posting, providing, transmitting or otherwise making available any materials or information infringing on the rights of a third party.
5. User Prohibitions - logging and posting as someone else.
Points League and consequences.



6 - 1 week - posting/replying ban.
13 - 3 Week - posting replying ban.
20 - 1 year Ban.

Prior to an initial infraction you will normally receive a warning from a Club VR-4 Committee member, this allows you to reconsider you actions before any infractions are applied.
The Committee reserves the right to take any decision that it considers to be in the best interests of the Club, including, but not limited to, imposing bans outside of the infractions guidelines, taking action in respect of events occurring outside of CVR4, other unforeseen circumstances that may arise, etc. It is expected that this provision will only be applied in very rare situations, if ever.
Appealling
Anyone issued an infraction has the right to appeal. This should be done by clicking the "Committee Feedback" Button located within the Infraction Private Message, this must be done within 7 days of the infraction being issued; it must include a full explanation as to why you feel the warning should be reviewed. The Club VR-4 Committee will then review the appeal, and the decision made will be a final decision and cannot be appealed a second time.5. User Prohibitions
Unauthorized access to registered areas of Club VR-4 by non-members is strictly prohibited. If you have a user password allowing access to a members area of this Site, you may not disclose or share your password with any third party(ies) or use your password for any unauthorised purpose.

Members given posting bans found to be registering one or more new users or using other usernames (whether previously registered by them or registered by others) in order to post and/or reply.
6. Links
Club VR-4 may provide links to other websites or resources. Because we have no control over such websites and resources, you acknowledge and agree that we are not responsible for the availability of such external sites and resources, and do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such websites or resources
7. Intellectual Property
Club VR-4 reserves the right to use any technical information and photographs posted onto the website by you, either in the forum, garage or gallery, for any Club VR-4 purpose, including advertising, merchandise, avatars etc.

All images relevant to the thread must be uploaded to Club VR-4 to retain the threads future value, images will be proactively uploaded to Club VR-4 by The Club VR-4 Committee, if not done by the poster; this ensures thread relevance and coherence - images uploaded in this fashon will be subject to the same conditions.

Any user may edit their posts for a period of 40 days. After this time the post will be automatically locked and it's content become the property of ClubVR-4. Any user may subsequently request the Committee to remove part or all of a specified post, but this is wholly at the discretion of the Committee who will look at such requests sympathetically.
8. CVR-4 Membership
To assist in the running costs of the website, ClubVR-4 introduced full Club Membership, for which a fee is payable. Please note that this fee could be subject to change without notice.

Subscribing to full Club Membership brings additional benefits over and above access to the public forums, such as receipt of a Membership Pack, access to the "Members Area" of the forum, product & services discounts negotiated with third parties, preferential rates for Club events and priority stand places at our many meets across the country throughout the year.

However, Club VR-4 welcomes all Galant and Legnum enthusiasts and understands that not everyone would benefit from full Club Membership.

Therefore, any posts by Registered Users will not be moved to the Members Area unless they contain information which is a direct benefit of full Club Membership, such as discounts that have been negotiated for full members.

Any technical information posted in the public forums can and may be copied to the Members Area for ease of searching, but the original thread will ordinarily remain in its original posted location.

Any queries regarding Membership must be posted in the appropriate section of the forum, or they may not receive a response.
9. Traders


9.01. A trader is defined as being an individual or company that seeks to sell / offer services to the CVR4 community through the medium of the CVR4 website with the intention of making money from this medium
9.02. Any individual or company offering parts from more than one vehicle within a 12 month period is classed as a trader , the exception to this is where the seller has purchased there own vehicle back for an insurer and has already offered parts from another vehicle , this is at the discretion of the CVR4 committee whose decision is final
9.03. Any individual or company offering services for financial reward whether by actual monetary gain or payment in kind is classed as a trader, offers of assistance by members is not classed as trading
9.04. All parties who enter into a trade with any Trader must be aware that CVR4 can not be held responsible nor accountable for any transactions.
9.05. All traders when entering into transactions with members must comply with the distance seller regulations and provide full contact details before any payment is taken. Failure of a trader to comply with the DSR must be reported to the committee before any payment is made , a warning will then be issued against the trader under the infraction scheme used by the site .
9.06. Any one found to be trading without being a registered trader will in the first instance be given a first and final warning , any further transgressions will result in infractions leading to a suspension of access right , no refund will be given in the event of suspension or permanent banning
9.07. CVR4 reserves the right to revoke or suspend a traders account in the event of complaints from the CVR4 community which have supporting evidence
9.08. CVR4 will act as an independent arbitrator for a period of 14 days in the event of any disputes between traders and the CVR4 community after this time the committee will decide if there is a case to answer based on the evidence presented by both parties , this decision is final and both parties will be made aware of the foundation for our findings
9.09. All Traders must comply with all local laws and are not permitted to sell items or offer services that could be deemed illegal by local law enforcement agencies.
9.10. Where any dispute raised with a trader who is also part of the moderation team or Committee, that member will be removed from the relevant moderation/Committee discussions and decisions.

10. Group Buys.

Please note that CVR4 never possess the items offered through the website nor is CVR4 involved in transactions between buyers and sellers. As a result, CVR4 have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. To help mitigate this we have setup the following conditions.


10.1. To organise and manage Group Buys (GB) on CVR4 you are required to be at least a Bronze Trader, failure to comply will see your GB threads deleted. This ensures that we have your contact details and that you have accepted the terms and conditions with regards to sharing those details in the event of a dispute.
10.2. For full transparency all Bronze & Silver Traders performing Group Buys must provide the contacts details of the business you are dealing with, this includes company name, contact names, address, telephone number and a GB reference number, this is not required for Gold Traders.
10.3. Any Monies sent via PayPal should not be sent as a gift to allow the usage of the buyers protection policy's, in the event of a dispute CVR4 will not be able to assist (provide contact details) if this was overlooked.
10.4. Where possible the payments should be made to the vendor directly.
10.5. Physical items must always be sent using recorded delivery methods, in the event of a dispute CVR4 will not be able to assist (provide contact details) if this was overlooked.

I just dropped into this thread to ask the same question as Peter!

Seems a little unfair as most GBs tend to be organised with no profit to the organiser and a gain to all members. It would seem to be not worth organising a GB in the future if it were to cost the member money IMHO

It's the actual trader status that worries me in terms of the discounts I was able to obtain having that applied may make it more difficult if i am seen to be a "trader" by the supplier rather than a private individual.
Selbys did log in to check at the progress of the Gb here and on OZVR4.

Having multiple payments to a supplier rather than a single one off may also effect the discount or even refusal of the GB. Selbys would not accept individual payments though it would have saved me £300 in exchange rate fees if they had :(

I guess the other worry is that trader status may also imply responsibility for a product bought and supplied to a group of individuals.

My interpretation of bronze trader status for group buys is that the organiser is aiming to do the group buy in an honest way and has given the club some small concessions to underline the point.

It sounds like the issue you guys aren't happy with is the title of "bronze trader" rather than the fundamental idea? I'm not sure what else you would call it though? Having ony recently left the commie redness, I do remember strong views about the clubs lack of group buy guidelines. I'd see this as a step forwards.

If the title was "CVR4 Groupie" or something, would that help? :P

I wonder if Bronze Trader and something like 'approved group buy coordinator' (for example) could run side-by-side instead?



This is the idea though; discussion to allow the T&Cs to continue to develop in the areas that matter to the members. /yes

Anything barr the "trader" title or something that implies you are running a business is a bad idea in my opinion. If I ran another group buy it would not be with a title along those lines. I'm not running a business and I would not like to feel I have been put in this position.

Most group buys as we know are set up by a club member and not a "trader" .We need a proper distinction between the 2.

I can see Peter's point on this side of things, couple of more questions..

1: What terms/approval status must a member sign up to to become an 'Approved Bronze Trader' ?
2: On completeing item 1 this hints that the Club will provide 'back up' to that 'trader' in unfortunate incidents that may (and do) arise out of a Group Buy?
3: If point 2 is correct then surely its not for the benefit of general members rather than the benefit of the trader?
4: If point 3 is incorrect then that imediatley takes away the incentive of someone investing their own time and money into a Group Buy as it opens the whole liability can of worms.

Are members allowed to reply to WTB threads??? Seems unfair that Bronze traders aren't!
