    Debt collecting anyone?

    Im looking for someone to go to a business premises and ask for my money back in person. Ive been on the phone to the business countless amount of times and for the last 5 weeks hes been fobing me off about the refund he owes me. Im owed £750sterling off him after i bought an engine for my legnum off him which was never delivered. Im only looking for someone to go up in person and ask for my money back in cash, im not looking for anyone to scare him or anything, unless you wanted to. But who ever gets the money back i will pay £150sterling to. The premises is in Portland Commercial estate in Barking. If anybody is seriously interested il PM them the full address.

    I work in insolvency, and could have done it if I was closer!

    Anyway, serious point of my post is that if someone volunteers for you, make sure you get a letter of authority/instruction for them to collect the funds on your behalf. Let me know if my help on this would be useful.

    Fairly straight forward - a 'to whom it may concern' letter from you, with your name and address details on it, details of the debt, and that you have instructed x to act on your behalf in collecting the debt and that x can deal with any matter regarding the debt with your full authority.

    Another thought - if you wanted me to put you in touch with one of my contacts, either a lawyer or process server/agent - I reckon that they would be able to collect the debt for you, no win no fee basis - maybe for a fee of less than £150?

    I assume that the company have stated in writing that you are due a refund of £750.00?

    Was the engine just not shipped? Or was it lost in transit?

    Yea that would be great if you could pass me on someones number. Forgot to mention all i have of proof of the purchase is on my credit card statment. Just says 01/02/2008 02/02/2008 MR ENGINE LTD BARKING €1,023.45
    would that be enough proof?

    Yes, it's usually a good idea to involve the CC company asap - they have a lot more clout than an individual. And the loss of their Merchant account may be a big problem for them?

    But does the Consumer Credit Act apply to non-UK residents - probably not?

    Is there not an equivalent Act in Ireland? AFAIK, the Consumer Credit Act applies only to Credit Card issuers in the UK, regardless of where the transaction takes place, so I guess the same would potentially apply if there is a similar Irish act.

    Anyway, do you have any emails etc, that can help document the transaction?

    It would all help with recovery.

    You only have a max of 100days since purchase for the CC company to intervene anything after that and they have no power, they were as helpful as possible and rang the company and laid out a few threats but still no refund.

    Ive asked them to send me a letter or at least an email saying that im getting a refund, how much and when but they say they send it and when i check theres nothing. Its the same when i ring them and and ask them how the refund is going, they simply say ''ohh have you not got that yet, i processed it last week, give me a call back in 10 minutes and il sort it out'' when i do call back 10minutes later they say ''yea that refund has gone through for you''. Ive been getting the exact same responses for the last 4 weeks now. I dont think there was ever even an engine on its way to me to be honest!

    Just refreshing this thread and letting people know that im upping the anty, due to unforeseen circumstances, im currently going through a serious cash shortage after buying an engine off a member here and need some income quickly. The reward for who ever collects the money is now up to 250sterling!
