    I agree, at least they have admitted it is their error, so they have to give you back your money. They are just trying to find a solution that suits them best. I don't think they will difficult. Just tell them that it is not acceptable and you want a full refund so you can get the car you want. They can sell the car where is is to someone.
    Also I don't think they will just walk away from the guy in Bolivia!, they will have his details and the details of the car, so they can contact him and sort it out or catch him when he tries to register the car. They won't let someone walk off with a E6000 car for e500 and not do anything!. Hang in there, I am sure you will get it worked out.

    Thanks for all the good references you gave to me! I think to get all the money back is not the best decision, because the exchange is so bad so that I loose again money. The best thing will be that the buyer in Bolivia message Frank and we simply change the cars. the second option that the Balance of money between the 2 cars is used for the exact car I want. I keep the car I received here and try to make some money with it. I think Frank and I will find a good arrangement for our problems.

    The noisy mechanical sounds I talked about might be from the hydraulic valve lifter a VR-4 specialist told me. So the sound will be away after a few minutes the oil warms up! We had already -10°C this morning.

    @crazydriver81: I will let you know first if the car is for sale!

    Something really important is also that Frank made the mistake and that it is not the mistake of his company. The blame is not for the company! Can anyone of the moderators edit the Title of the thread and rename it like "!HELP! Frank ship the wrong VR-4 to me!"

    Sorry, does Frank work for autotraderimports.com, or does he just use their website? If he works for them, then as a general rule of thumb, the company is liable for any actions of their employees. I guess it would depend to some extent on local law in the relevant country, but it normally holds true.

    i did some reading up and japan have really strict consumer rights..even better than europe. The National Consumer Affairs Center of Japan
    Like above does frank work for this company and as i said before the japanese embassy are very very helpful and no doubt would be able to tell you the laws and regs in japan concerning your matter.

    I have two concerns over this:

    1. You have paid out X amount in Euros in total, therefore X should be converted back to (Y)en and refunded to you. No loss should be incurred by their error, although I guess this is a risk you take with the markets.

    2. If you order a replacement car you will be liable for the import costs of that car too and therefore will lose more than what you would from a refund at the current rate. I would be very careful with this option.


    I don't claim to be an expert on VR4s but I've had a lot of experience working on mine and have learnt a lot from 3 years on this forum, I'm also not exactly close to Bremerhaven or Berlin (Moenchengladbach) but I'm happy to try and help you out in any way I can with the car sat at the docks. I can also speak some German if it's any use.

    The latest news. At first thanks again for all your useful posts here. Nice to have some guys feeling with me. ;-) The car has arrived in Bloivia last week! The customer will keep the car, that was to be expected unfortunately. So I have to find an arrangement with Frank.

    I hope they had to pay the difference! Sorry to hear you won't be getting the car you wanted but at least there seems to be some progress for you.

    Hello everybody!

    The good news are that I am going to get a beautiful Legnum from Frank for a really low price. We have found a really good arrangement.

    So the Legnum he shipped wrong to me is for sale now! The car is in Berlin, Germany! Maybe somebody is interested in? Tax and everything else is payed and I have all the important papers of the car!

    Details:

    Mileage: 173.000 km
    Interior: the leather looks great, no bigger wearing except the steering wheel, a bit dirty
    Exterior: great! The car is auction grade 4, which is good for a used car!

    The price is 4000€!
